Terms of Service

These Terms of Service ("Terms") govern your access to and use of the ExtremeSMS application and related services ("Service"). By installing or using the Service, you agree to these Terms.

1. Service Description

ExtremeSMS provides SMS and MMS messaging services integrated with GoHighLevel, enabling users to send and receive messages through GoHighLevel Conversations, Workflows, and Campaigns.

2. Eligibility

You must:

• Have a valid GoHighLevel account
• Be legally permitted to send SMS messages
• Use the Service for lawful business purposes only

3. Acceptable Use

You agree not to use the Service to:

• Send spam or unsolicited messages
• Use purchased, rented, or scraped contact lists
• Harass, threaten, or abuse recipients
• Transmit illegal, deceptive, or harmful content
• Circumvent opt-outs, DND, or carrier restrictions

We reserve the right to suspend or terminate accounts violating these rules.

4. Compliance Responsibility

You are solely responsible for:

• Obtaining recipient consent
• Complying with TCPA, CAN-SPAM, GDPR, and similar laws
• Completing A2P 10DLC or other carrier registrations when required
• Honoring STOP, UNSUBSCRIBE, and opt-out requests immediately

ExtremeSMS does not provide legal advice.

5. Billing and Payments

• Subscription fees and usage-based charges may apply.
• Usage may be measured via GoHighLevel billing meters.
• Fees are non-refundable except where required by law.
• Failure to pay may result in suspension or termination.

6. Message Delivery & Carrier Responsibility

ExtremeSMS provides messaging services on a best-effort basis. Message delivery is dependent on factors outside of ExtremeSMS's control, including but not limited to mobile carrier networks, recipient device availability, content filtering, network congestion, regulatory restrictions, and third-party service providers.

ExtremeSMS does not guarantee the delivery, timeliness, or receipt of any message. Messages may be delayed, blocked, filtered, or fail to deliver without notice due to carrier policies or network conditions.

ExtremeSMS shall not be liable for:

• Messages not delivered, delayed, or filtered by carriers
• Messages blocked due to carrier compliance rules or content filtering
• Network outages or degradation
• Recipient device limitations or settings
• Regulatory or carrier-mandated restrictions

Fees associated with messages that are accepted for delivery by ExtremeSMS but not delivered by carriers are non-refundable, except where required by law.

By using the Service, you acknowledge that SMS delivery is not guaranteed and agree that ExtremeSMS is not responsible for carrier-level delivery failures.

7. Suspension and Termination

We may suspend or terminate access if:

• You violate these Terms
• You engage in prohibited or high-risk messaging
• Required payments are not made
• Carriers or regulators require suspension

Upon termination, access to the Service will cease.

8. Limitation of Liability

To the maximum extent permitted by law:

• ExtremeSMS is not liable for indirect, incidental, or consequential damages
• Our total liability shall not exceed the fees paid by you in the preceding 30 days

9. Modifications

We may update these Terms at any time. Continued use of the Service constitutes acceptance of the updated Terms.

10. Governing Law

These Terms are governed by the laws of Delaware USA, without regard to conflict of law principles.
